Terms and Conditions for usage of uaev.ae Website and UAEV App
Acceptance
Please read these Terms and Conditions carefully. These are the general Terms and Conditions governing your access and use of the uaev.ae website and the UAEV App (the “Platforms”). IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT USE THE PLATFORMS. By continuing to use the Platforms, you agree to be bound by these Terms and Conditions.
Conduct
- Use the Platforms to commit a criminal offense or to encourage others to engage in any conduct which would constitute a criminal offense or give rise to civil liability;
- Post or transmit any discriminatory, libellous, harassing, defamatory, obscene, pornographic, or otherwise unlawful content;
- Use the Platforms to impersonate other parties or entities;
- Use the Platforms to upload any content that contains a software virus, "Trojan Horse" or any other computer code, files, or programs that may alter, damage, or interrupt the functionality of the Platforms or the hardware or software of any other person who accesses the Platforms;
- Upload, post, email, or otherwise transmit any materials that you do not have a right to transmit under any law or under a contractual relationship;
- Alter, damage, or delete any content posted on the Platforms;
- Disrupt the normal flow of communications in any way;
- Claim a relationship with or represent any business, association, or other organization with which you are not authorized to claim such a relationship or represent;
- Post or transmit any unsolicited advertising, promotional materials, or other forms of solicitation;
- Post any material that infringes upon or violates the intellectual property rights of another; or
- Collect or store personal information about others.
Copyright
Copyright in the pages and in the screens displaying the pages, and in the information and material therein and in their arrangement, is owned by Etihad Water and Electricity Company PJSC (“EtihadWE”) unless otherwise indicated. No material from the Platforms may be copied, distributed, transmitted or used without expressed written permission from EtihadWE. Any unauthorized misuse of copyrighted materials could be in violation of copyright, trademark, publicity or privacy laws.
No warranty
You expressly understand and agree that your use of the Platforms is at your own risk. Neither EtihadWE nor its employees warrant that the Platforms will be uninterrupted, problem-free, free of omissions, or error-free; nor do they make any warranty as to the results that may be obtained from the use of the Platforms. The information and materials contained in the Platforms, including text, graphics, links or other items are provided "as is," and "as available". EtihadWE does not warrant the accuracy, adequacy or completeness of the information and materials and expressly disclaims liability for errors or omissions therein. No warranties of any kind, implied, express or statutory are given in conjunction with the information and materials.
Indemnity
You agree to defend, indemnify, and hold harmless EtihadWE and all of its employees and agents from any and all liabilities incurred in connection with any claim arising from any breach by you of these Terms and Conditions, including reasonable attorneys' fees and costs. You agree to cooperate fully in the defence of any such claim. EtihadWE reserves the right to assume, at its own expense, the exclusive defence and control of any matter otherwise subject to indemnification by you. You agree not to settle any matter without the written consent of EtihadWE
Exclusion of Liability
EtihadWE is not responsible for any technical, hardware or software failures of any kind; lost or unavailable network connections; incomplete, garbled or delayed transmissions. It assumes no liability for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with the Platforms.
Hyperlinks to other internet resources not owned by EtihadWE are at your own risk. The content, accuracy, opinions expressed, and other links provided by these resources are not investigated, verified, monitored, or endorsed by EtihadWE When you select a link to an outside website, you are subject to the terms and conditions of that platforms.
This Exclusion of Liability clause shall take effect to the fullest extent permitted by law.
Variation
EtihadWE reserves the right to modify these Terms and Conditions. The modified Terms and Conditions will be published on this page and any modification will be effective immediately upon posting. Your use of the Platforms following posting of any modification signifies your acceptance of such modification.
Governing law & jurisdiction
EtihadWE has established these Terms and Conditions for use of the Platforms in accordance with the federal laws of the UAE and all applicable governmental rules and regulations. Whenever a person breaches these Terms and Conditions, EtihadWE reserves the right to use the law to its fullest extent to protect its infrastructure and information. The federal courts of UAE shall have exclusive jurisdiction to settle any dispute in connection with these Terms and Conditions.
